By using the ProTickets workspace and related tools:
- You acknowledge that you have read, understood and agree to be bound by these Terms of Service and our Privacy Policy.
- If you are using ProTickets on behalf of a business or organization, you confirm that you have authority to bind that entity to these terms.
- If you do not agree to these terms, you must not access or use ProTickets.
- You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use ProTickets.
- These terms form a legally binding agreement between you and ProTickets regarding your use of the workspace, data and services.
- You agree to comply with all applicable local, state, provincial and federal laws while using our services.
Your subscription and trial:
- New users may be offered a 14-day free trial of the Pro plan so they can evaluate the full workspace before committing.
- Unless otherwise stated on the pricing page, paid plans are billed on a recurring basis (for example monthly or annually) until cancelled.
- Billing occurs on or around the same calendar day each period, based on your initial subscription date and chosen plan.
- Plans, pricing and features for each plan are described on our pricing page and may change over time.
- You may cancel your subscription at any time from your account settings; access continues until the end of the current billing period.
- Except where required by law, we do not issue refunds or credits for partial billing periods or unused services.
- We may update prices or plan structure in the future; where required, we will give you advance notice and an opportunity to cancel before changes take effect.
- Taxes, fees and currency (for example USD pricing for Canadian or other international users) are indicated at checkout or on the pricing page and are your responsibility.
What ProTickets provides:
- Access to a workspace designed for ticket resellers, including features such as Discover Events, Favorites, Codes Manager, Calendar, Data Explorer and related extras (for example Chrome extension, Discord, training).
- Access to data, analytics and workflows intended to help you research events, organize presale codes, plan buying sessions and monitor secondary-market demand.
- From time to time we may add, modify or remove features to improve the product, address security or compliance requirements, or respond to market needs.
- Certain features or integrations may only be available on specific plans, in certain regions or for compatible devices and browsers.
- We do not guarantee that any specific feature, dataset or integration will remain available for any minimum period of time.
- While ProTickets is built to support professional workflows, we do not promise or guarantee any specific financial outcome, profit level or event result.
- The service is provided on an “as is” and “as available” basis and may experience occasional interruptions, maintenance windows or updates.
Your account and security:
- You must provide accurate, complete and current information when creating and maintaining your ProTickets account.
- You are responsible for keeping your login credentials (such as email, password and any multi-factor authentication method) confidential.
- You are responsible for all activity that occurs under your account, whether or not you authorized it.
- You agree to notify us promptly if you suspect unauthorized access to your account or any security incident.
- We reserve the right to suspend or terminate accounts that provide false information, violate these terms or are otherwise used inappropriately.
- You may not sell, transfer or share your account access with another person or organization without our prior written consent.
- We may ask you to update account information periodically so we can keep your profile, billing and compliance information accurate.
How you may and may not use ProTickets:
- You agree to use the workspace, data and tools only for lawful purposes and in a way that respects other users, venues, artists and marketplaces.
- You will not attempt to bypass security measures, access data or parts of the service you are not authorized to access, or interfere with the normal operation of ProTickets.
- You will not attempt to reverse engineer, decompile or otherwise inspect our code or systems except where this is allowed by applicable law that cannot be excluded.
- You will not use automated scripts, bots or scraping tools to access, copy or export large volumes of data from ProTickets without our express written consent.
- You will not resell, redistribute or publicly expose our data, analytics or internal tools as a separate product or service.
- You will not upload, post or share content that is illegal, harmful, abusive, defamatory, infringing, or that violates the rights of others.
- You will comply with the terms of any third-party platforms you interact with while using ProTickets (for example primary or secondary ticket marketplaces).
- You are solely responsible for complying with any local regulations, licensing or tax requirements that apply to your ticket reselling activity.
Ownership of the ProTickets service and content:
- All software, design, text, graphics, data models, analytics, documentation and other content inside ProTickets are owned by us or our licensors and are protected by intellectual property laws.
- Our name, logos, product names, domain names and associated brand assets are trademarks or trade dress of ProTickets and may not be used without our written permission.
- Any recommendations, analytics or insights surfaced by the workspace are derived from our systems and data and remain our intellectual property.
- Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable license to access and use ProTickets for your internal business or personal ticket reselling activities.
- This license does not allow you to reproduce, modify, distribute, sell or create derivative works from our software, data or content other than as necessary to use the workspace for your own brokerage.
- If you choose to submit feedback, ideas or suggestions about ProTickets, you agree that we may use that input without obligation to you and without limiting our rights to develop similar or related features.
How we handle your information:
- Our collection, use and protection of personal data is described in detail in our Privacy Policy, which forms part of these terms.
- By using ProTickets, you consent to the processing of your information as described in the Privacy Policy, including any cross-border transfers where applicable.
- We use industry-standard security measures to help protect your information, but no online service can be 100% secure.
- We may use aggregated or anonymized data derived from your usage to improve ProTickets, develop new features and understand market trends.
- We do not sell your personal information to third parties; we may share data with service providers and partners who help us deliver and improve the service, subject to contractual safeguards.
- You are responsible for ensuring that any information you provide about third parties (for example contact details of team members) is shared in compliance with applicable laws.
Important legal limits on our responsibility:
- ProTickets is a tool that helps you research events and manage your workflow; it does not place trades or make financial decisions for you.
- We do not provide financial, investment, legal or tax advice. Any decisions you make using information from ProTickets are your own responsibility.
- While we work hard to keep data accurate and up to date, we cannot guarantee that every event, code or market datapoint is complete, current or error-free.
- The service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
- To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities.
- To the extent we are found liable despite these limitations, our total aggregate liability for all claims relating to the service will not exceed the amount you paid for ProTickets in the 12 months before the event giving rise to the claim.
- Different jurisdictions do not allow all of these limitations, so some of the above may not apply to you where prohibited by law.
When we or you can end access to ProTickets:
- You may stop using ProTickets at any time and can cancel your subscription from within your account settings.
- We may suspend or terminate your access, with or without notice, if you materially breach these terms, use the service in a way that creates risk for us or others, or fail to pay fees when due.
- We may also suspend or limit access temporarily for maintenance, security updates or to address misuse.
- Upon termination, your right to access and use ProTickets will cease immediately, but certain provisions of these terms (such as limitations of liability and indemnification) will continue to apply.
- We may retain and/or delete your account data in accordance with our Privacy Policy and legal obligations.
Specific disclaimers about ticket markets and analytics:
- Ticket resale markets are volatile and influenced by many factors outside of our control, including artist decisions, venue policies, platform rules, consumer demand and macroeconomic conditions.
- Any projected profit, demand score or market signal shown in ProTickets is based on historical and current data and is not a guarantee of future performance.
- You should not rely on ProTickets as your only source of information when making significant financial decisions.
- You remain solely responsible for how you use our data, including which events you choose to buy into, how much capital you allocate and how you price or list inventory.
- We are not responsible for losses arising from cancelled events, changing venue policies, technical issues on third‑party platforms or decisions made by artists, leagues or marketplaces.
Your responsibility if someone else brings a claim:
- To the extent permitted by law, you agree to indemnify and hold harmless ProTickets and its affiliates, officers, employees and agents from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to your use of ProTickets, your violation of these terms or your violation of any rights of another person or entity.
- We may, at our discretion, assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our handling of that matter.
- Your indemnification obligations will survive termination of your account and your use of the service.
What happens when your account ends:
- If your account or subscription is terminated, your right to use ProTickets stops immediately, and you must stop accessing the workspace and any restricted areas of the site.
- We may choose to delete or anonymize some or all of your account information, subject to any legal or regulatory retention requirements.
- Any fees owed up to the date of termination remain payable, and we may charge your payment method for any outstanding amounts.
- Sections of these terms that by their nature should continue to apply after termination (including ownership provisions, disclaimers, limitations of liability and indemnity) will continue in effect.
How these terms are interpreted and how disputes are handled:
- These terms and your use of ProTickets are governed by the laws of the jurisdiction specified on our site or in your subscription documentation, without regard to conflict of law principles.
- Any disputes arising out of or relating to these terms or your use of ProTickets will be resolved in the manner described in this section and any additional dispute‑resolution terms presented to you in the product.
- Where permitted by law, you and ProTickets each waive the right to participate in class actions or class‑wide arbitration against the other party.
- Nothing in these terms prevents either party from seeking interim or injunctive relief in a court of appropriate jurisdiction to protect its rights or confidential information.
- Consumers and users in certain regions may have additional rights under local consumer protection laws, which take precedence over parts of these terms to the extent they cannot be waived.
How we update this document:
- We may update these Terms of Service from time to time to reflect product changes, legal requirements or business needs.
- When we make material changes, we will provide notice by updating the “Last Updated” date, showing an in‑product banner or sending you an email, where required.
- If you continue to use ProTickets after changes take effect, you are agreeing to the updated terms.
- If you do not agree with the updated terms, you should stop using ProTickets and, if applicable, cancel your subscription before the changes become effective.
- The current version of these terms will always be available on our website for you to review.
